Conditions of access

This legal disclaimer contains the conditions of access and navigation through the Website (“Terms of Use”). The navigation through the Website attributes to the visitor the condition of user (“User”) and implies the full and unconditional acceptance of these Terms of Use. The navigation through the Website is free of charge and does not require the prior registration of the User. Access to the Website is reserved for persons over 18 years of age. Navigation through the Website and use of the contents available therein is made, in any case, under the sole responsibility of the User.

Intellectual and Industrial Property

E-HEALTH is the owner or has the corresponding licenses on the intellectual and/or industrial property rights on the content, design and source code of the Website, including the software that supports it and, especially, on the photographs, images, texts, logos, graphics, designs, brands, commercial names and materials that are hosted and made available to Users through the Website. The trademarks, logos and/or any other distinctive signs of third parties that eventually are included on the Website are the property of their legitimate owners and are protected by Law; its use is strictly prohibited without the express consent of their corresponding owners. In no case does the access or use of the Website grant the User any rights over the brands, logos and/or distinctive signs included therein. The User only has a right of personal (noncommercial) use to the contents of the Website in accordance with these Terms of Use, for informational purposes. In no case shall it be understood that access and navigation through the Website implies a waiver, transmission, license or total or partial cession of said rights by E-HEALTH for exploitation, reproduction, public communication, dissemination, disclosure and/or transformation of the Website or its contents.

Prohibitions

The User must make use of the Website in full respect of the current legislation and these Terms of Use, under their sole responsibility. The Linked Sites are not owned or controlled by E-HEALTH, so E-HEALTH is not responsible for the quality, updating, availability, legality and/or utility of the contents and/or services available on the Linked Sites. The existence of Linked Sites on the Website does not imply the approval, recommendation, promotion, affiliation or sponsorship of said Linked Sites. The use that Users make of the contents and/or services available on Linked Sites are not the responsibility of E-HEALTH and will be governed and regulated by the conditions of use and privacy policies of said Linked Sites.

Guarantees and limitation of responsibility

Although all reasonably possible measures have been taken to ensure the proper functioning of the Website and the services available therein, and to avoid the existence and transmission of vulnerabilities and harmful components, given the nature of the Internet, E-HEALTH cannot guarantee the full invulnerability of the Website or the server that supplies it. Although it makes every effort to make the functionalities and contents of the Website available, updated and free of errors, E-HEALTH does not guarantee its full reliability, usefulness, accuracy, availability, updating and continuity of the contents and functionalities at all times and consequently, it is not responsible for the consequences derived from the use thereof by the User.

E-HEALTH is not responsible for: (i) any possible security errors that may occur due to the use of non-updated software versions or the consequences that may arise from the malfunction of your device, either by inadequate configuration, presence of computer viruses or any other cause over which E-HEALTH is not responsible; (ii) of the contents, whatever the same, that the User eventually transmits or sends to E-HEALTH through the communication and contact channels available on the Website; (iii) of service interruptions, delays, errors, malfunctioning of the Website and, in general, of any inconvenience that have its origin in causes beyond the control of E-HEALTH or in actions or services of third parties and/or due to fraudulent or negligent action of other Users or third parties -attack of hackers, crackers or other third parties to the security or integrity of the computer system-, and / or that have origin in causes of Force Majeure; and (iv) the damages or losses caused to the User or to a third party by any person that infringes the conditions that E-HEALTH establishes for the use of the Website.

E-HEALTH excludes any liability for damages, losses or incidents or inconveniences of any nature that the User or third parties may suffer as a direct or indirect consequence of the actions listed above. Likewise, E-HEALTH reserves the right to suspend, restrict and/or interrupt access to the Website at any time and without prior notice, whether for technical reasons, security, control, maintenance, power supply failures or for any other founded cause. In no case can be held responsible for the discontinuity or lack of availability of the Website.

Breach and indemnity

In case of breach of these Terms of Use by the User and without prejudice to any legal action that may be taken in each case, E-HEALTH reserves the right to suspend, restrict, cancel and/or terminate without prior notice, access to the Website. Likewise, the User agrees to hold harmless and, where appropriate, compensate and indemnify E-HEALTH, its directors, employees, affiliates, agents and any other related persons, in respect of any claims, liabilities, damages, losses, expenses or any other concepts that are a consequence of any violation of the provisions of these Terms of Use by the User.

Modification

E-HEALTH reserves the right to modify these Terms of Use at any time, either for its adaptation to possible regulatory changes, due to technical modifications of the Website and/or its functionalities, or as a consequence of changes in the nature of the services available therein, by publishing the current Terms of Use on the Website or through any type of communication addressed to Users. The use of the Website once the modification is published will imply acceptance of the Terms of Use in force at that time.

Legislation and jurisdiction

These Terms of Use are governed by Spanish law and any dispute about the validity, interpretation, execution or termination of its provisions will be subject to the exclusive jurisdiction of the Bilbao Courts, without prejudice to the rights that assist in this area to Users that have the status of consumers.
